Confiscation, Restraints & Cash Forfeitures

Protecting What Matters

Confiscation, Restraints & Cash Forfeitures.

Financial restrictions under the Proceeds of Crime Act (POCA) can disrupt your life and your livelihood. If your assets have been frozen or seized, early expert legal advice is essential. At Brooklyn Law, we act swiftly to challenge restraint and confiscation orders and protect your legal and financial position.

Restraint Orders and Asset Freezing

A restraint order can be obtained against you even before a charge is made. It can prevent access to your own money and cause significant distress. We work to challenge unjustified orders or vary them to allow access to living expenses and legal costs.

We’ll liaise with the prosecution, file urgent applications, and represent you in court, fighting your case even under tight time pressures.

Confiscation Proceedings Post-Conviction

Following a conviction, the court may impose a confiscation order to recover the value of ‘criminal benefit’. These calculations are often inflated or incorrect. We scrutinise the prosecution’s case thoroughly, ensuring that only lawfully obtained assets are taken into account.

If necessary, we’ll bring in financial experts to counter exaggerated valuations or hidden asset claims.

Cash Forfeiture and Border Seizures.

If cash has been seized from you, whether at home, in transit, or at a port of entry, we can help. You don’t have to be convicted for your money to be forfeited. We provide robust representation at forfeiture hearings, challenging weak or unlawful seizures and pushing for the return of funds.

Whatever the problem, we can help.
