Our Expertise

Confiscation & Asset Recovery

We have a dedicated confiscation department that focuses on getting your assets back.

Confiscation and Asset Recovery.

We have a dedicated team that can represent you in serious and complex confiscation proceedings and who will focus on providing the best legal advice to protect your assets or assist you in having your assets returned. Your assets may have been frozen as part of a Restraint Order even prior to any decision to prosecute. An application can be made to the court to vary or revoke the Order in certain instances. If you are convicted of a criminal offence, in some cases, the prosecution will review any income and assets acquired in the last 6 years which can result in a serious financial impact on you, and we understand how stressful this can be. Failure to comply with a confiscation can also result in financial penalties and possible prison time and so it is important to have the right legal team alongside you to navigate this process.

Whatever the problem, we can help.

Are your assets legitimate?

The onus is on the defendant to prove that their assets and income are legitimate. This is hugely onerous and a painstaking task. We at Brooklyn Law are used to dealing with such matters in an efficient and thorough manner, preparing defence bundles of material to counteract prosecution inferences on a defendant’s assets.

It may also be the case that your asset has been forfeited as a third party as a result of an order against a defendant. In such circumstances, robust representations need to be made to the court, to protect your interests. Don’t act too late, our early advise is key to successful challenge
